Abuse is defined as "any physical or mental injury or sexual assault inflicted on a resident other than by accidental means . . ." and neglect is defined in as, "a facility's failure to provide, or willful withholding of, adequate medical care, mental health treatment, psychiatric rehabilitation, personal care, or assistance with activities of daily living that is necessary to avoid physical harm, mental anguish, or mental illness of a resident."
  • The law protects a resident's ability to report mistreatment without the threat or implementation of retaliatory action against the resident.
  • If a nursing facility violated a resident's rights, the resident is entitled to be compensated for "actual damages and costs and attorney's fees." This is a significant departure from most lawsuits where the general rule is that each party is responsible for the party's own costs and attorney's fees.
